The Examining Counsel model has a long history in New York State as well as many other areas of the country. Acting in the capacity of counsel to the title insurance underwriter, the EC performs many of the critical research, analysis and reporting functions on behalf of the underwriter - including but not limited to reading and proofing of the abstract and courthouse documentation, mediation and clearance, risk analysis and determination of insurability.
In this capacity, the EC acts as counsel to the title insurance underwriter, earning a portion of the risk premium commensurate with the work performed to guarantee the integrity and marketability of title on behalf of the underwriter.
The philosophy of title insurance is one of preventative insurance. The process of insuring the integrity and marketability of title and mitigating risk involves an intricate series of investigative research, analysis and reporting performed by numerous individuals at all levels of the title insurance transaction.
The risk premium for insuring the owner’s property rights and the integrity of the underlying real estate transaction are earned for the performance of these complex practices and the financial guarantee of their legitimacy.
